TERMS AND CONDITIONS – S&W Atelier

These terms and conditions have been drafted in accordance with Dutch legislation and European consumer directives. They apply to all purchases made via the webshop of S&W Atelier (http://swatelier.nl). S&W Atelier is a general partnership (vennootschap onder firma) established at Blokzijlpark 46, 3826 BN Amersfoort, registered with the Dutch Chamber of Commerce (KvK) under number 98946218.
1. Applicability
These terms and conditions apply to every order placed via our webshop. By placing an order, you agree to these terms. In the event of discrepancies between a translated version and the Dutch text, the Dutch version shall prevail.
2. Offer and Order
All products on our website constitute an invitation to place an order. An agreement is only concluded once you have received an order confirmation by email.
S&W Atelier reserves the right to refuse or cancel an order in the event of obvious errors in the offer, such as pricing or typographical errors.
S&W Atelier also reserves the right to refuse individuals who excessively make use of the return process in the S&W Atelier online shop.
Customer accounts may be deactivated in case of suspicious activities or detected fraud.
3. Prices and Payment
All prices include VAT and exclude shipping costs, unless stated otherwise.
Payment must be made in advance using the payment methods we offer (such as iDEAL or credit card).
4. Delivery
Orders are dispatched as quickly as possible. The delivery time is indicated with the product. Exceeding the delivery time does not entitle you to compensation.
Please check your details carefully; if a parcel cannot be delivered due to an incorrect address, any additional costs will be at your expense.
If delivery proves impossible (e.g. product out of stock), you will be informed in time and the amount paid will be refunded.
5. Shipping Costs
Shipping costs vary per order and destination. The shipping costs for your order are shown once you have entered your address.
6. Returns (Right of Withdrawal)
A. Withdrawal from the Agreement
You have the right to return your order within 14 days after receipt without giving any reason. This period is calculated from the day you receive the products.
If the last day of the withdrawal period falls on a public holiday, Saturday, Sunday, 24 December, or 31 December, the deadline will be extended to the next working day.
You have exercised your right of withdrawal in time if you notify us before the expiration of the period that you wish to withdraw.
If you wish to withdraw from the agreement, you must send (preferably by email) a clear statement to S&W Atelier [General Partnership, Blokzijlpark 46, 3826 BN Amersfoort, email: retour@swatelier.nl] indicating your decision to withdraw. Your statement must include:

The withdrawal period for gift cards is also 14 days.
B. Arranging the Return Shipment
From the moment you notify us of your withdrawal, you must return the products within the previously mentioned 14 days.
Withdrawal is considered timely if you hand over the products to a postal service or another carrier before the 14-day period expires. As proof, you must retain the shipping receipt and tracking code. You are responsible for the returned items until we receive them.
You will receive a refund for the purchased items (excluding the original shipping costs).
The product must be undamaged, unused, and—where reasonably possible—in its original condition and packaging. Return shipping costs are at your own expense.
Refunds will be processed within 14 days after we have received and inspected your return. Refunds will be made using the same payment method as the original transaction. Depending on the payment method, it may take longer for the refund to appear in your account.
Cancellation of an Order
An order cannot be cancelled once it has been placed. After an order is placed, we are no longer able to stop the shipping process. In that case, you may return the order after receipt in accordance with our return policy. You will receive a refund once we have received the product in good condition. Return shipping costs are at your own expense.
Please note: personalized products cannot be returned unless there is an error or damage upon delivery.
7. Warranty and Complaints
Our products comply with the statutory warranty (in accordance with Article 7:18 of the Dutch Civil Code): they must meet the expectations you may reasonably have. If there is an issue with a product, please contact us within 14 days via info@swatelier.nl.
8. Liability
We strive to provide accurate information and pricing on our website. If errors occur, no rights can be derived from them. Our liability is limited to the amount paid for the relevant product. We are not liable for indirect or consequential damages unless such limitation is not permitted by law.
9. Intellectual Property
All designs, images, and texts on our website are the property of S&W Atelier. You may not copy, use, or distribute them without permission.
10. Force Majeure
In cases of force majeure (such as a pandemic, strikes, or supplier issues), we may temporarily suspend our obligations or cancel the agreement. In such cases, we will always contact you.
11. Applicable Law and Disputes
These terms and conditions are governed by Dutch law. Disputes may be submitted to the competent court in the province of Utrecht. As a consumer, you may also use the European Online Dispute Resolution platform via: https://ec.europa.eu/consumers/odr. We kindly ask you to contact us first if you have a complaint.
